Terms of Service

These Terms of Service ('Terms') govern your access to and use of the Ruff & Royal website, design tools, AI image-generation features, and products (together, the 'Service'). The Service is operated by SKYDOME DIGITAL TRADING TECHNOLOGY LLC ('Company', 'we', 'us'). By using the Service or placing an order, you agree to these Terms. If you do not agree, do not use the Service.
Who May Use the Service
You must be at least 18 years old, or the age of majority where you live, to make a purchase or hold a paid membership. You are responsible for your account, for keeping your login credentials secure, and for all activity that occurs under your account.
How the Service Works
Ruff & Royal lets you upload your own designs or generate images with AI, preview them on apparel and other products, and place orders. We do not manufacture products ourselves. When you order, we send the order and design information needed for production to our third-party print-on-demand partner, Printify, who makes your item and ships it directly to you.
AI Image Generation
Our AI features generate images from the prompts and inputs you provide. AI output can be unexpected, inaccurate, or similar to images generated for other users; we do not guarantee that any generated image is unique, error-free, or fit for a particular purpose. You are responsible for reviewing generated images before you order or export them, and your use of these features is subject to our Acceptable Use Policy.
Ownership & License of Generated Images
As between you and us, and subject to your compliance with these Terms and payment of any applicable fees, you may use the images you generate (including for commercial purposes), and we do not claim ownership of them. Important: under current U.S. Copyright Office guidance, works created solely by AI may not be eligible for copyright protection. We therefore do not warrant that you can obtain or enforce exclusive rights in an AI-generated image, and we grant no exclusivity. Your ownership of images you have already generated is not affected by your credit balance or by the expiry of any credits; separately, downloading or exporting the image files requires a paid account, as described in our Subscription & Membership Policy.
Your Content & the License You Grant Us
You are solely responsible for any design, image, text, or other material you upload or submit ('User Content'), and you represent that you own it or have all rights and permissions needed to use it. You grant us and our fulfillment partners a worldwide, non-exclusive license to host, reproduce, adapt for production, and print your User Content and generated images solely to operate the Service and fulfill your orders.
Prohibited & Infringing Content
You may not upload, generate, or order content that infringes anyone's intellectual-property, publicity, or privacy rights, or that is otherwise unlawful, as further described in our Acceptable Use Policy. Our print partners independently screen orders and may reject content that violates their rules. We may refuse, cancel, or remove any order or content that we or our partners believe violates these Terms or the law.
Orders, Pricing & Payment
All orders are offers to buy and are subject to our acceptance and to product availability. Prices are shown in U.S. dollars unless stated otherwise and may change at any time. Applicable sales tax and shipping are calculated at checkout. We may correct pricing or description errors and cancel affected orders even after an order is placed.
Credits, Subscriptions & Reward Credits
Credits, subscription plans, credit packs, what each feature costs, when credits expire, image export rights, and reward credits earned on orders are governed by our Subscription & Membership Policy, which forms part of these Terms. Ownership of the images you generate is addressed in these Terms, above.
Intellectual Property in the Service
The Service itself — including our software, branding, text, and design — is owned by us or our licensors and is protected by law. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. You may not copy, resell, reverse-engineer, or misuse the Service.
Disclaimers
The Service and all products are provided 'as is' and 'as available' to the fullest extent permitted by law. We disclaim all warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
Limitation of Liability
To the fullest extent permitted by law, the Company and its partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service or a product is limited to the amount you paid for the order or membership giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless the Company, its officers, and its fulfillment partners from any claims, damages, or costs (including reasonable legal fees) arising from your User Content, your generated images, your use of the Service, or your violation of these Terms or the law.
Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or misuse of the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination will continue to apply.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Any dispute will be resolved through binding individual arbitration, and you and the Company waive the right to a jury trial and to participate in a class action, except where prohibited by law. You may opt out of arbitration as described in any separate arbitration notice we provide.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms with a new 'Last updated' date and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
